1. Acceptance of Terms
By accessing or using TourNest CRM (the "Service"), operated by GodopeTZA Labs Company Limited ("we," "our," or "us"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with any part of the Terms, you must not use the Service.
2. Description of Service
TourNest CRM is a tourism-focused customer relationship management platform that allows travel companies to manage leads, bookings, customer communications, and analytics. We provide integrations with WhatsApp Business API, Google Mail API, and payment processors such as Stripe and Pawapay.
We act solely as a software provider. We are not a travel agent or tour operator and are not responsible for the fulfillment of any travel services booked through the platform.
3. User Accounts
You must create an account to access most features. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
4. Subscription & Billing
We offer multiple subscription plans, including a free tier. Details of each plan, including pricing and usage limits, are available on our pricing page.
Paid plans are billed in advance (monthly or annually, as selected during checkout) through Stripe or Pawapay. You authorize us to charge the applicable fees to your chosen payment method.
4.1 Free Tier
The free tier provides limited access to the Service. We reserve the right to modify or discontinue any free features at any time without notice.
4.2 Refund Policy
Refunds are available upon request if no usage of paid features has occurred during the current billing cycle. Usage is determined at our sole discretion based on platform logs.
5. Service Availability & SLA
We target a 99.5% monthly uptime. Scheduled maintenance and factors outside our reasonable control (e.g., force majeure, third-party outages) are excluded from uptime calculations.
In the event of a prolonged outage, we will credit affected subscribers as described on our status page or in a separate SLA document.
6. Prohibited Use & Termination
You agree not to use the Service for any illegal or unauthorized purpose or to violate any applicable laws and regulations. We may suspend or terminate your account, without refund, if you:
- Engage in illegal activities or fraud
- Misuse APIs or access unapproved features
- Violate these Terms or any third-party terms incorporated herein
7. Intellectual Property
All content, trademarks, and logos of the Service are our property or licensed to us. You may reference or display our logo only if your company is integrated with or partnered with TourNest CRM and strictly in accordance with our brand guidelines. Any other use requires prior written consent.
8. Data Ownership & Export
You retain ownership of all data you upload to the Service. You may request a data export or deletion at any time by contacting us at benard@flutterai.dev or using the built-in tools.
You represent that you have the necessary rights and permissions to upload all content and that such content does not infringe or violate any laws or third-party rights. We reserve the right to sanitize or remove content that violates these rules.
9. Third-Party Integrations & APIs
The Service integrates with third-party APIs and services, including but not limited to WhatsApp Business API, Google Mail API, Stripe, and Pawapay. Your use of these integrations is subject to each provider's terms. By enabling an integration, you agree to comply with the applicable third-party terms, which are hereby incorporated by reference.
If a third-party provider increases fees, alters functionality, or discontinues its service, we may adjust our pricing, limit functionality, or discontinue the affected feature without liability.
10. Supplier & Booking Liability
We facilitate software tools only and do not act as an agent for any travel supplier. Each supplier is solely responsible for honoring bookings and related customer service. Our liability is limited to the subscription fees paid to us and does not extend to the cost of any travel services.
11. Pricing Changes
We may revise subscription fees by providing at least 30 days' notice via email or through the Service. Continued use of the Service after the new fees take effect constitutes acceptance of the revised pricing.
12. Disclaimer of Warranties
The Service is provided on an "as-is" and "as-available" basis, except for the uptime commitment stated in Section 5. We disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose.
13. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the amount of subscription fees you paid to us in the 12 months preceding the event giving rise to the claim.
We are not liable for indirect, incidental, special, or consequential damages, including lost profits, loss of data, or business interruption.
14. Indemnification
You agree to indemnify, defend, and hold harmless GodopeTZA Labs Company Limited and its affiliates from any claims, damages, or expenses arising out of your use of the Service, violation of these Terms, or infringement of any rights of a third party.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the United Republic of Tanzania, without regard to its conflict of law principles. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Dar es Salaam, Tanzania.
16. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after the changes become effective constitutes acceptance of the updated Terms.
